Terms of Service
By using CaseGuardian, you agree to these terms. CaseGuardian is operated by CaseGuardian L.L.C., a wholly owned subsidiary of Quantum Companies Global L.L.C.
Eligibility & age requirement
CaseGuardian is intended for users who are 18 years of age or older. By creating an account you represent that you meet this age requirement and have the legal capacity to enter into this agreement. The app is not directed to children under 13, and we do not knowingly collect data from children under 13. If we learn we have collected such data, we will delete it.
Not legal advice
CaseGuardian is a documentation and evidence-organization tool. It is not a law firm and we do not provide legal advice. Use of the app, AI parsing features, the Legal Glossary, and Help / How-To content does not create an attorney-client relationship. Always confirm legal questions with a licensed attorney in your jurisdiction.
Acceptable use & user-generated content
You agree to use CaseGuardian only for lawful purposes related to documenting and sharing materials you have a right to capture and share. You will comply with applicable recording-consent laws in your jurisdiction. You are solely responsible for content you upload, capture, or share through the app (“User Content”).
You will not upload, transmit, or share content that:
- is illegal, obscene, defamatory, threatening, harassing, or hateful, or that incites violence;
- sexually exploits or endangers minors (CSAM is strictly prohibited and will be reported to authorities);
- infringes intellectual property, privacy, or publicity rights of any third party;
- contains malware, spam, or attempts to compromise the service;
- impersonates another person or misrepresents your affiliation.
We reserve the right (but have no obligation) to review, refuse, or remove User Content that violates these Terms or that we, in our sole discretion, determine is objectionable. We will act within 24 hours on credible reports of objectionable content or abusive users. Reports may be sent to support@case-guardian.com.
AI features (opt-in)
CaseGuardian offers optional AI parsing on individual captures and documents (for example, extracting dates from a court order or summarizing an audio note). AI parsing is off by default on every item. It runs only when you affirmatively toggle it on for that specific item. You may turn it off again before sealing the package.
Before any AI request leaves your device, CaseGuardian runs an on-device personally identifying information (PII) pass that redacts your name, phone number, email, mailing address, payment information, and the names of people in your life from the document. The redacted item is then sent over an encrypted connection to our AI sub-processor, Anthropic, for the limited purpose of producing the output you asked for. Anthropic is contractually prohibited from training on or retaining your content.
AI output is informational only, may be inaccurate, and is not legal advice. You are responsible for reviewing and verifying AI output before relying on it. We are not liable for decisions you make based on AI output.
Review before sealing
Sealed share links, attorney packages, and Kid Calendar exports show a full review screen before anything is transmitted. You are responsible for reviewing each package and confirming its accuracy and appropriateness before tapping Seal. We are not liable for content you elect to seal and share.
Bitcoin anchoring & cryptographic timestamps
CaseGuardian uses the Bitcoin blockchain via the public OpenTimestamps calendar network as an immutable, third-party ledger to anchor cryptographic fingerprints (32-byte SHA-256 hashes) of your captures. The fingerprint is signed by the OpenTimestamps calendar network within seconds of capture and confirmed into a Bitcoin block typically within one to three hours. The Verify page surfaces both stages so you (and any recipient) can see the cryptographic chain at each step. By using CaseGuardian, you acknowledge and agree that:
- No money service business activity. CaseGuardian L.L.C. does not buy, sell, hold, custody, or transmit cryptocurrency on your behalf or its own. CaseGuardian L.L.C. is not registered as, and does not operate as, a money service business or money transmitter, and is not registered with FinCEN.
- You are not buying Bitcoin. You do not need a wallet, an exchange account, or any cryptocurrency to use the Service. You pay no transaction fees, no gas, and no on-chain costs. Your interaction with the Bitcoin blockchain is one-way: a hash of your data is anchored to the public ledger.
- Third-party dependency. Anchoring depends on the continued operation of the OpenTimestamps calendar network and the Bitcoin blockchain — both of which are public, independent infrastructure outside CaseGuardian’s control. We do not warrant that any specific anchor will be created within any specific time, or that calendar operators will operate uninterrupted.
- Verification is math, not adjudication. A successful verification proves the fingerprint was present at or before a specific Bitcoin block. It does not authenticate who captured the file, prove the contents are truthful, or guarantee admissibility under any rules of evidence.
- Public-ledger permanence. Bitcoin anchors exist in the public ledger forever, by design. The fingerprint alone is on-chain — no personal information, no content, no identifying detail is included — but the fingerprint itself cannot be retracted. Account deletion does not remove past anchors.
Kid Calendar entries
The Kid Calendar lets you record custody schedule type (including 50/50), verbal-agreement percentages, and an attempted-pickup log. These entries are user-supplied records, not legal determinations or court orders. Entering a percentage or schedule in CaseGuardian does not modify any custody order, parenting plan, or court decree. Use them as documentation to share with your attorney; do not rely on them as legal status.
Recipient verification
When creating a secure share link, you must enter the recipient’s phone number and email address. Both are required as essential security controls so only the intended recipient can unlock the sealed materials. The recipient must verify possession of both the email inbox and the mobile number before the sealed package decrypts. The access code is delivered by SMS and the share link is delivered by separate email, so the code and the link never travel together in the same message. You attest that you have the recipient’s permission to be contacted at that phone number and email for this purpose.
SMS messaging
By providing a phone number, you agree to receive transactional SMS from CaseGuardian (verification codes, share-link access codes, and security alerts) as described in our SMS Consent Policy. Separately and optionally, you may opt in to promotional SMS (product updates, tips, and feature announcements); marketing messages are sent only with that additional, explicit consent — never on the basis of the transactional opt-in alone. Reply STOP to opt out of either at any time.
Intellectual property
CaseGuardian™ (also referred to as “Case Guardian”) and the CG Share Link™ feature, including all related names, logos, brand marks, software, source code, designs, screens, copy, documentation, and underlying technology, are the exclusive property of CaseGuardian L.L.C. and are protected by United States and international copyright, trademark, and other intellectual property laws. © CaseGuardian L.L.C. All rights reserved.
You are granted a limited, revocable, non-exclusive, non-transferable license to use the app for its intended purpose. You may not copy, modify, reverse engineer, redistribute, sublicense, or create derivative works of CaseGuardian or CG Share Link without the prior written consent of CaseGuardian L.L.C.
Subscriptions & in-app purchases
CaseGuardian offers auto-renewing subscriptions purchased through the Apple App Store or Google Play. Pricing, billing period, and any free-trial terms are shown on the in-app paywall before purchase. Payment is charged to your Apple ID or Google account at confirmation of purchase. Subscriptions automatically renew at the same price unless auto-renew is turned off at least 24 hours before the end of the current period; your account is charged for renewal within 24 hours prior to the end of the current period.
You can manage and cancel subscriptions at any time in:
- iOS: Settings → [your name] → Subscriptions.
- Android: Play Store → Profile → Payments & subscriptions → Subscriptions.
Deleting the app alone does not cancel a subscription. Any unused portion of a free trial, if offered, is forfeited when you purchase a subscription. Refunds are handled by Apple or Google under their policies; we cannot directly issue App Store / Play Store refunds.
Account deletion
You may delete your account and associated data at any time from inside the app under Profile → Legal & Privacy → Delete Account. For your protection, account and profile deletion are gated behind your device’s biometric authentication (Face ID, Touch ID, or Android biometric) with a passcode fallback. You can also email support@case-guardian.com from your registered address. Deletion removes your account data and uploaded evidence from active systems within 30 days, except where retention is required by law. Bitcoin anchors associated with past captures remain on the public Bitcoin ledger (as cryptographic fingerprints only, containing no personal information) and cannot be retracted.
DMCA & copyright complaints
If you believe content on CaseGuardian infringes your copyright, send a written notice including: (1) your signature; (2) identification of the copyrighted work; (3) the location of the allegedly infringing material; (4) your contact information; (5) a good-faith statement; and (6) a statement under penalty of perjury that you are authorized to act. Send notices to our DMCA agent at support@case-guardian.com.
Disclaimers & limitation of liability
CaseGuardian is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We are not a law firm and do not provide legal advice. Use of the platform does not create an attorney-client relationship. AI output is informational only and may be inaccurate.
To the maximum extent permitted by law, CaseGuardian L.L.C. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or relating to your use of the service. Our aggregate liability shall not exceed the greater of (a) amounts you paid us in the 12 months preceding the claim, or (b) US $100.
Indemnification
You agree to indemnify and hold harmless CaseGuardian L.L.C. from any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising from your User Content, your use of the service, or your violation of these Terms or applicable law.
Termination
We may suspend or terminate your access at any time for violation of these Terms or applicable law. You may stop using the service and delete your account at any time. Sections that by their nature should survive (intellectual property, Bitcoin anchoring, disclaimers, limitation of liability, indemnification, governing law) will survive termination.
Governing law & dispute resolution
These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-laws principles. The exclusive venue for any dispute not subject to arbitration shall be the state or federal courts located in Sheridan County, Wyoming. You and we agree to first attempt to resolve any dispute informally by contacting support@case-guardian.com. If unresolved within 30 days, disputes will be resolved by binding individual arbitration administered under the rules of the American Arbitration Association, except that either party may bring claims in small-claims court. Class actions and class arbitrations are waived to the extent permitted by law.
Apple App Store — Licensed Application terms
The following applies if you obtained CaseGuardian through the Apple App Store:
- These Terms are between you and CaseGuardian L.L.C. only, not with Apple. Apple is not responsible for the app or its content.
- Your license to use CaseGuardian is limited to a non-transferable license to use it on Apple-branded products that you own or control, as permitted by the App Store Terms of Service.
- Apple has no obligation to provide maintenance or support for the app.
- Apple is not responsible for addressing any claims by you or any third party relating to the app, including product liability, legal / regulatory compliance, or consumer-protection claims.
- In the event of any third-party claim that the app or your possession and use of it infringes intellectual property rights, Apple will have no responsibility for the investigation, defense, settlement, or discharge of such claim.
- You represent that you are not located in a U.S.-embargoed country and are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated in-app or by email at least 7 days before they take effect. Continued use after the effective date constitutes acceptance.
