SMS Messaging Consent & Privacy Policy
How CaseGuardian uses SMS to deliver secure, court-grade evidence share links and verification codes, and how you control them.

1. Program description
CaseGuardian is a sealed evidence platform used by parents, guardians, journalists, caregivers, and their attorneys to document legal matters. We operate a single 10DLC messaging campaign with four use cases. Every message either confirms an action the end user just took in the app, delivers a security credential the recipient must hold to access shared materials, or, with separate explicit consent, sends an optional product update.
The four use cases:
- Account verification (2FA OTP). One-time codes sent when a user signs in, confirms a phone number, or authorizes a new device.
- Account security alerts. Password resets, new-device sign-in notifications, and unauthorized-access warnings.
- Sealed share access codes. One-time access codes delivered to a named recipient (typically an attorney) whose phone and email the account holder entered into the app. The share link itself is delivered separately by email, so the code and the link never travel together in the same message.
- Optional product updates (separate marketing opt-in). New-feature announcements and tips, sent only to users who give a separate, explicit, unchecked-by-default marketing opt-in. Never sent on the basis of the transactional opt-in alone.
We do not run third-party messaging through this number. We do not sell, rent, or share phone numbers.
2. How users opt in (proof of consent)
Consent is collected inside the CaseGuardian mobile app at the moment a user requests a messaging-dependent action. The full in-app flows are documented with mock screens at sms-opt-in.html. Summary:
- Account holders, transactional (use cases 1 and 2): During sign-up or when enabling phone-based two-factor authentication, the user manually types their own phone number into a labeled field and taps a button labeled "Send verification code." Adjacent disclosure text reads: "By tapping Send verification code, you agree to receive an SMS verification code from CaseGuardian. Message frequency varies. Message and data rates may apply. Reply STOP to opt out, HELP for help."
- Share-link recipients (use case 3): The account holder enters the recipient’s phone number and email address into a Case-Share form and taps a button labeled "Create secure share link." Both contact methods are required and are essential security controls: the recipient must verify possession of the email inbox and the mobile number before the sealed materials decrypt. The SMS sent contains only a one-time access code and opt-out language; the share link itself is delivered separately by email. Adjacent disclosure text reads: "By tapping Create secure share link, I attest that I have the recipient’s permission to be contacted at this phone and email for the purpose of receiving sealed case materials. CaseGuardian will send the recipient a one-time access code by SMS. Message frequency varies. Message and data rates may apply. Reply STOP to opt out, HELP for help."
- Marketing opt-in (use case 4, separate and optional): Product updates are sent only if a user additionally toggles a distinct, unchecked-by-default "Send me product updates by SMS" control in Settings and confirms. This marketing consent is independent of the transactional opt-in above: a user can receive verification codes and security alerts without ever consenting to marketing, and can withdraw marketing consent at any time without affecting transactional security messages.
Opt-in is logged with a timestamp, the user’s account ID, the IP address of the device, and the exact phrasing of the consent disclosure shown at that time. These records are retained for 4 years and available on request to our messaging provider (Sent.dm) and to regulators.
3. Message frequency & sample content
Transactional message frequency varies by user action; most users receive fewer than 5 transactional messages per month. Promotional messages are sent only to users who separately opt in to marketing, at most a few per month, and every promotional message includes STOP-to-opt-out language. Below, every sample is labeled with the use case it satisfies, matching the four use cases in §1.

4. Opt-out (STOP)
You can cancel SMS messages from CaseGuardian at any time by replying STOP to any message we send. After replying STOP you will receive a single confirmation message and will not receive further SMS from CaseGuardian unless you opt in again from inside the app. To resume, reply START or re-enroll by re-entering your phone number in the app.
5. Help (HELP)
For help with our SMS program, reply HELP to any message and you will receive a reply with our support contact information. You can also email support@case-guardian.com. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
6. Privacy & phone number handling
Phone numbers collected by CaseGuardian are used to deliver the messages the user has opted into, transactional security and delivery messages for everyone who provides a number, and promotional messages only for users who separately opt in to marketing. We do not sell, rent, or share mobile numbers, opt-in data, or consent records with third parties or affiliates for their own marketing. Phone numbers entered for case-share recipients are stored encrypted and used only to send the specific share message and to confirm recipient identity when the link is opened.
